By accessing or using Sample Risk Scanner ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Sample Risk Scanner provides automated sample detection against a database of commercial recordings. Our Service analyzes audio files you upload and identifies potential matches with existing copyrighted material.

3. Important Disclaimer

Sample Risk Scanner is a detection tool, not legal advice. Scan results indicate detected matches and confidence levels only. They are NOT a determination of:

  • Copyright status or ownership
  • Fair use or transformative work status
  • Sample clearance requirements
  • Legal liability or infringement

Detection coverage is not exhaustive. For commercial releases involving any sampled, interpolated, or derivative material, you should consult a qualified music attorney before distribution.

4. User Accounts

To use our Service, you must create an account. You are responsible for:

  • Providing accurate account information
  • Maintaining the security of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

5. Subscription Plans

Billing

Paid subscriptions are billed monthly in advance. You authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be provided for partial months.

Plan Limits

Each plan includes a specific number of monthly scans. Unused scans do not roll over to the next month. Exceeding your plan limits requires upgrading to a higher tier.

6. Acceptable Use

You agree not to:

  • Upload files you do not have the right to analyze
  • Use the Service for any illegal purpose
  • Attempt to reverse engineer our detection technology
  • Share your account credentials with others
  • Resell or redistribute our Service without authorization
  • Upload malicious files or attempt to compromise our systems

7. Intellectual Property

You retain all rights to the audio files you upload. We do not claim ownership of your content. Our Service, including its technology, branding, and interface, remains our exclusive property.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAMPLE RISK SCANNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Copyright claims or legal action arising from your releases
  • Missed detection of samples or copyrighted material
  • False positive detections
  • Loss of revenue or business opportunities
  • Data loss or service interruptions

9. Indemnification

You agree to indemnify and hold harmless Sample Risk Scanner from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

11. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
